New York Driver Arrested for Suspected DUI

Fairfield (NJ) The Fairfield Police Department announces the arrest of Russell Cooke (37) of Baldwinsville, N.Y. for driving under the influence on July 7, 2017. On that date, at approximately 1:57 A.M., Officer Jeffrey Dean was monitoring traffic on Route 46 when he observed a 2003 Chevrolet traveling west. As he followed behind this vehicle, it is alleged that the vehicle failed to maintain its lane. It was stopped and found to be operated by Cooke.

During the course of the stop, it is alleged that Cooke displayed signs and symptoms consistent with being under the influence to include a strong odor of an alcoholic beverage coming from his breath, watery and bloodshot eyes, and fumbling hand movements. As a result of these observations, field sobriety tests were administered and, based upon the totality of the circumstances; Cooke was placed under arrest, transported to police headquarters and his vehicle impounded pursuant to New Jersey law.

While at headquarters, it is alleged that Cooke refused to submit to giving samples of his breath for the purposes of conducting chemical testing. In addition to being charged with driving under the influence, he was also charged with driving under the influence in a school zone, refusal to submit to a breath test, failure to maintain a lane, suspended driver and careless driving. He was released on his own recognizance pending an initial appearance in the Fairfield Municipal Court on July 20, 2017.

(It should be noted that the charges against Cooke are merely allegations and that he is presumed innocent until he either pleads guilty or is found guilty in a court of law)
