New York Resident Arrested for Driving While Intoxicated Following Motor Vehicle Stop

Fairfield (NJ) The Fairfield Police Department announces the arrest of Miguel Osorio-Guzman (43), of New York, NY for driving while intoxicated on May 28, 2023. On that date at approximately 3:19 am, Officer Jesse Schnackenberg was on patrol when he allegedly observed a white Nissan Pathfinder driving carelessly on Fairfield Road. This included the vehicle being driven on the wrong side of the road into oncoming traffic. Officer Schnackenberg conducted a motor vehicle stop and found Osorio-Guzman to be the driver and only occupant. While speaking with Osorio-Guzman, Officer Schnackenberg allegedly observed signs and symptoms consistent with someone who may be under the influence, to include bloodshot and watery eyes as well as the odor of an alcoholic beverage emanating from the vehicle. It is also alleged that Osorio-Guzman’s movements were slow and he dropped his documents several times attempting to hand them over to the officer.


Based on the totality, field sobriety testing was conducted and Osorio-Guzman was subsequently placed under arrest for driving while intoxicated. The vehicle was impounded pursuant to NJ law.


Osorio-Guzman was transported to headquarters for processing. Breath samples were provided for testing purposes and the results were found to be above the legal limit. In addition to being charged with driving while intoxicated, Osorio-Guzman was charged with having an open container of alcohol in the vehicle, as well as several other motor vehicle summonses. Osorio-Guzman was later released pending a June 8, 2023 appearance at the Fairfield Municipal Court.
